Rules worth knowing in New York

  • PIP pays up to $50,000 per person for medical bills, lost earnings (up to $2,000 a month for up to 3 years) and other reasonable expenses (up to $25 a day for up to 1 year). You can buy an extra $25,000 of optional coverage.
  • To sue for pain and suffering, you need a serious injury, such as a fracture, significant disfigurement or dismemberment.
  • Uninsured motorist coverage at 25/50 is required. Optional supplementary uninsured/underinsured motorist (SUM) coverage goes up to your bodily injury limits, capped at 250/500, and insurers usually set it equal to those limits unless you decline or choose less in writing.
  • Insurers may use credit, but not as the only reason to deny you, and they cannot use it to cancel, nonrenew or raise your renewal premium. Age, sex, marital status, where you live and mileage can also affect your rate.
  • The DMV does not accept out-of-state insurance, and coverage must stay active for the whole registration period, even if you do not drive. A lapse can lead to a registration suspension; for lapses of 90 days or less, a civil penalty of $8 to $12 a day can be paid.
  • New York enforces coverage through insurer reports and lapse penalties, so if you are asked for an SR-22 or similar proof of insurance, check the requirement and how long it lasts with the New York DMV.
