Rules worth knowing in Texas
- If you reject PIP in writing, your insurer does not have to add it back at renewal unless you ask for it in writing.
- Uninsured and underinsured motorist coverage must be offered on every new policy, but not again at renewal if you declined it. The Texas Office of Public Insurance Counsel lists a $250 deductible for uninsured and underinsured motorist property damage claims.
- Insurers may use your credit, but cannot turn you down or charge you more based only on your credit score. If credit affects your rate, your insurer must refresh it at least every 36 months, and you or your agent can ask for a re-rate once every 12 months.
- An insurer cannot refuse to renew your policy only because of the age of anyone it covers, or make you exclude a family member who reaches driving age. A widowed driver cannot be charged a different rate than a married driver.
- Instead of a policy, you can use a surety bond, a $55,000 cash or securities deposit with the Texas Comptroller, a cash or cashier's check deposit with the county judge, or self-insurance.
- Texas requires an SR-22, filed with the Texas Department of Public Safety, after a crash-related suspension, a second or later conviction for driving without insurance, or a civil judgment, and you must keep it for 2 years from the conviction or judgment date.
